I would like to first of all thank you for taking the time to read this letter. I am desperately seeking legal help. I will try to keep this letter as concise as possible.
Background
I am 29 years old currently. I have been incarcerated since April 25, 1998, at the age of 15. I have two codefendants, one is now deceased. My codefendants both pled guilty to all charges, taking responsibility for the crimes committed; waving their M.A.P. hearings and trial. I on the other hand was tried as an adult after my M.A.P. hearing. I have no prior arrests, or convictions for any crimes. I also was found guilty at the jury trial of all charges against me: Agg. Kidnapping, kidnapping (x2), rape (x2), agg. Sodomy, agg. Robbery, agg. Burglary, agg. Battery, and criminal possession of a fire arm.
Issues
(Ineffective counsel) Both of my codefendants were willing to testify or either write letters in my behalf, my attorney decided not to pursue it. (Many other small details also).
(mishandling or tampering with crucial evidence) after being arrested and questioned for hours, we were all taken to the juvenile Detention Facility and stripped of our clothing, all in a pile on the floor together. DNA evidence proved that none of my DNA was found on the victim, but my codefendants were, and vice versa. However, during trial state’s witness testified that one of my codefendants DNA was found on my boxer shorts? Not possible.
(Judicial misconduct) Being tired as an adult with no history or pattern of delinquent behavior, and lacking the maturity of an adult.
I was sentenced to 669 months, while in RDU, I received a letter and a new journal entry saying that my sentence was now 412 months. I was originally sentenced illegally, and it was corrected outside of my presence, to 412 months, which is double the prescribed 206 months for severity level 1 with no criminal history.
I am seeking any possible remedy; new trial, sentence reduction, etc.
I hope that this is plenty of information that you may be interested in pursuing further.

I’m sorry to hear about the injustice your brother has suffered. Try contacting thctrust.org or Gordon Hall. Ive heard they have helped people in these situations. I know you can start by getting a copy of the original indictment by doing discovery.

Ven…I am aware of adding UCC 1-308 “without prejudice” above my signature to reserve my rights and have been for sometime. The whole time wondering why it works so good. Thanks to Col.Wilson (how to get diplomatic immunity) I found : It may however, be considered settled that letters and admissions containing the expression in substance that they are to be “without prejudice” will not be admitted as evidence….An arrangement stating the letter was “without prejudice” was held be inadmissible as evidence….not only will the letter bearing the words “without prejudice” but the answer thereto, which was not so well guarded, was inadmissible…Ferry V Taylor 33 MO. 323; Durgin V Somers, 117 Mass 15; Molyneaux V Collier 13 Ga. 406….Thank you for all your hard work on the site…Peace
